AO and AO Series 2013 Pick ‘Em Competition
Conditions of Entry
1. Information on how to enter the AO and AO Series 2013 Pick ‘Em Competition (Competition),
mechanics of entry and prizes form part of these Conditions of Entry.
Entry into the Competition is deemed acceptance of these Conditions of
Entry. Entry is via Internet only.
2. The Promoter is Tennis
Australia Ltd, (ABN 61 006 281 125) trading as Tennis Australia,
Melbourne Park, Batman Avenue, Melbourne, Victoria, 3000 (Promoter).
Eligibility to enter the Competition
3. Entry is only open to residents of Australia aged 18 years or older (Entrants).
Entrants can only enter in their own name. The Promoter reserves the
right to request the winner to provide proof of age, identity and
residential address, in order to claim a prize. If the identity
of an Entrant is disputed, the authorised account holder of the e-mail
address submitted at the time of entry into the Competition will be
deemed to be the Entrant. The individual assigned to the e-mail address
by an online service provider, Internet access provider or other
organisation responsible for assigning the e-mail address for the
domain associated with the submitted e-mail address is the authorized
account holder.
4. Proof of age, identification and residential
address considered suitable for verification is at the discretion of
the Promoter. In the event that a winner cannot provide suitable proof,
the winner will forfeit the prize in whole and no substitute will be
offered. The Promoter reserves the right to verify the validity
of entries and to disqualify any entry which, in the opinion of the
Promoter, can be considered objectionable, profane, potentially
insulting, inflammatory or defamatory, or any Entrant whose entry is
not compliant with these terms & conditions of entry or who has, in
the opinion of Promoter, engaged in conduct in entering the Competition
which is fraudulent, misleading, deceptive or generally damaging to the
goodwill or reputation of the Competition and/or Promoter. The Promoter
reserves the right in its sole discretion to disqualify any individual
who the Promoter has reason to believe has breached any of these
conditions, or engaged in any unlawful or other improper misconduct
calculated to jeopardise the fair and proper conduct of the
Competition. Only one entry is permitted per person.
5.
Contractors and employees (and their immediate families) of the
Promoter, or any of its agencies or contractors involved with this
Competition are ineligible to enter the Competition.
Key Competition Dates
6.
The Competition starts at 1200am (EST) on 29 December 2012 and ends at
5:00pm (EST) on 27 January 2013 (Competition Period). All entries
received after this time are ineligible for entry into the Competition
and no responsibility will be accepted by the Promoter for lost, late
or misdirected entries. All entries are deemed to be received at the
time of receipt of the web entry into the Competition database and NOT
at the time of transmission by the Entrant.
Competition Entry Procedure
7. To enter this Competition, Entrants must:

register for the Competition using their Facebook account and submit an
online registration via (pickem.ausralianopen.cominsert website).
Each entrant must supply a valid email address. If an entrant does not
have a Facebook account they can obtain one at www.facebook.com.

Each Entrant must read through these Conditions of Entry, click "I
AGREE" to confirm agreement with the Conditions of Entry and fill in
the information on the registration. Once the Entrant clicks the
'SUBMIT' button, and Entrant will automatically enter the Competition.
How to Win
8. The Competition requires Entrants to correctly predict the winners of Australian Open (AO) and Australian Open Series (AOS)
matches during the Competition Period. This is a game of
skill and chance plays no part in determining prize winners.
9. Each day of the Competition Period (Eligible Day),
Entrants must can log onto (http://pickem.australianopen.com) and
select the winners of the AO or AOS matches being played that day (up
to 10 selections). Daily matches will also be emailed to Entrants
as a reminder by 6 AM AEST on the day of each Eligible Day’s
matches. Entrants must make all selections for each
Eligible Day by 11:00AM AEST on each Eligible Day (match selections for
that Eligible Day will no longer be able to be made or edited after
that time).
10. When entering their picks on each Eligible Day,
Entrants will also be asked to answer a tiebreaker question at the end
of each day will be used to resolve any tie between Entrants.
11.
Entrants will earn points for predicting winners. The number of
points earned is based on that Eligible Day's value for correct
predictions is. The values are:
Day 1: +1 points for each correct prediction
Day 2: +1 points for each correct prediction
Day 3: +2 points for each correct prediction
Day 4: +2 points for each correct prediction
Day 5: +3 points for each correct prediction
Day 6: +3 points for each correct prediction
Day 7: +4 points for each correct prediction
Day 8: +4 points for each correct prediction
Day 9: +5 points for each correct prediction (AO only)
Day 10: +5 points for each correct prediction (AO only)
Day 11: +6 points for each correct prediction (AO only)
Day 12: +6 points for each correct prediction (AO only)
Day 13/14: +7 points for each correct prediction (AO only)
The Registered Participant will earn zero (0) points for incorrect predictions or for making no selection.
12. The Entrant who earns the most points during each Eligible Day will win a minor prize (Minor Prize Winner).
In the event of a tie, the Entrant whose tiebreaker prediction is
closest to the actual result will win the tiebreaker and be that
Eligible Day’s Minor Prize Winner. If no tiebreaker value was entered,
an Entrant’s default prediction value will be zero (0). In the event
that a Minor Prize Winner is not determined after applying this
tiebreaker format, the Entrant who registered for the Competition first
will be deemed the Eligible Day’s Minor Prize Winner.
13. The
Entrant who earns the most points over all Eligible Days during the
Australian Open Competition Period (14 - 27 January 2013) will win the
major prize (Major Prize Winner).
In the event of a tie, the Day 13/14 tiebreaker question will be used
to determine the Major Prize Winner. The Entrant whose tiebreaker
prediction is closest to the actual result, will win the tiebreaker and
be the Major Prize Winner. If no tiebreaker value is entered, an
Entrant’s default prediction value will be zero (0). In the event
a Major Prize Winner is not determined after applying this tiebreaker
format, the Entrant who registered for the Competition first will be
deemed the Major Prize Winner.
Prize Winners
14. The Minor Prize Winners will receive:
(a) for each Eligible Day during the AOS (29 December 2012- 12 January 2013): an AO pin valued at $5.00.;
(b)
for each Eligible Day during the AO (14-27 January 2013): an AOS prize
pack including a towel, tin of tennis balls, sweatband and TA magazine
and posters, valued at $88.50;
15. The Major Prize Winner will receive:
(a) A framed photo and signed camera plate
Elements
of this prize are a ‘money can’t buy’ experience and otherwise the
package is valued at $200 (but is not available for retail sale).
16.
The prizes are not transferable, exchangeable or redeemable for cash.
The prize values are accurate at the date of commencement of the
Competition. The Promoter accepts no responsibility for any variation
in the value of a prize after that date. Refunds will not be made in
respect to unused services or prizes. Where a prize, or part of a
prize, is unavailable, the Promoter retains the right to substitute the
prize (or part) with a prize (or part) of equal or greater value.
17.
The Promoter’s decision and all matters pertaining to this Competition
will be final. No correspondence will be entered into.
18. Any additional travel or accommodation costs incurred by a prize winner are their own responsibility.
19.
In the event that for any reason whatsoever a winner does not take an
element of the prize at the time stipulated by the Promoter then that
element of the prize will be forfeited by the winner and cash will not
be awarded in lieu of that element of the prize.
Notification and Collection of Prizes
20.
The Prize Winners will be contacted by email using contact details
provided in their entry by 1 February 2013 and notified of how the
prize will be delivered.
21. The prizes remain the property of
the Promoter until claimed by the prize winners or the redraw winners
(if any). The prizes cannot be changed once the bookings have been
made. The prizes are all subject to hotel and flight
availability.
Privacy
22.
By entering this Competition, Entrants understand and agree that the
Promoter may use and disclose the information provided, including the
Entrant's personal information, to administer the Competition and
announce the winner. The Entrant consents to the Promoter providing the
Entrant's personal information to organisations that assist the
Promoter with administering the Competition and announcing the winner,
and to third parties as required by law (including authorities that
regulate this Competition). If the Entrant is not willing for this to
occur it cannot participate in the Competition. Entrants consent to the
Promoter using the Entrant’s personal information to advise it of
promotions, events, special offers and other like activities offered by
the Promoter or its stakeholders. Except where permitted or
required by law, or where the Entrant’s consent is obtained, this
information will not be disclosed to third parties. Entrants are able
to access personal information which they provide as part of their
entry by contacting the Promoter upon reasonable notice.
Discontinuance and Disqualification of Competition
23.
The Promoter reserves the right to discontinue the Competition at any
time and at its sole discretion may cancel, terminate, suspend or
modify the competition and/or, if necessary, to provide an alternative
prize or prizes to the same value as an original prize or prizes. Any
change to or cancellation of this Competition, for whatever reason, is
subject to the written direction of all relevant State and Territory
legislative departments.
24. Without limiting the foregoing, the Promoter reserves the right, in its sole discretion, to disqualify any Entrant:
(i) for tampering with the entry process or the Competition generally;
(ii) for otherwise acting in violation of these terms and conditions.
Exclusion of Liability
(a)
The Promoter takes no responsibility for the loss of prizes due to
incorrect or imprecise delivery or contact details provided by an
Entrant.
(b) To the extent permitted by law, the Promoter makes
no representations or warranties as to the quality, suitability or
merchantability of any of the goods or services offered as prizes.
(c) The Promoter is not responsible for losses associated with any change to the value of any prizes.
(d)
To the extent permitted by law, the Promoter is not liable for any loss
suffered or sustained to personal property and including, but not
limited to consequential (including economic) loss by reason of any act
or omission, deliberate or negligent, by the Promoter, or its servants
or agents, in connection with the arrangements for supply, or the
supply, of any goods or services by any person to the prize winner(s)
and where applicable, to any persons accompanying the winner.
Facebook
The
Game is in no way sponsored, endorsed or administered by, or
associated with, Facebook. Facebook is completely released of all
liability by each entrant in this Game. Any questions, comments or
complaints regarding the Game must be directed to the Game
Promoter and not Facebook. You understand that you are providing
your
information to the Game Promoter and not to Facebook.
